1. Who we sell to

empenzofashion.com is a business-to-business (B2B) wholesale platform. By placing an order or submitting a request you confirm that you are acting for a business and not as a consumer.

2. Stock offers are not sold through the shopping cart

Ready-stock lots listed on this site are offered on a request basis. Nothing on a stock-offer page is a binding offer to sell. A sale exists only when Empenzo issues a written confirmation (proforma invoice or sales contract) and the buyer accepts it.

3. Availability

All lots are subject to prior sale. Quantities, size ratios, colour counts and photographs are supplied by the source and are indicative. Lots are sold on an as-is, where-is basis unless the written confirmation says otherwise.

4. Prices

Prices shown to approved buyers are indicative per-piece FOB prices in US dollars, exclusive of freight, insurance, duties and taxes. Prices may change until a written confirmation is issued.

5. Buyer access and confidential information

Brand names, label images, supplier identity, packing details and warehouse locations are released only to approved trade buyers. Approved buyers must not republish, forward or use that information for any purpose other than evaluating a purchase from Empenzo. Access may be withdrawn at any time.

6. Offers made through the site

An offer submitted through the Make an offer form is an invitation to negotiate. Empenzo may accept, counter or decline it. No price is agreed until confirmed in writing by Empenzo.

7. Samples

Samples are a paid service. Please see our Refund policy and Shipping policy.

8. Limitation of liability

To the fullest extent permitted by law, Empenzo total liability in connection with any transaction is limited to the amount actually paid to Empenzo for that transaction. Empenzo is not liable for indirect or consequential loss, including loss of profit or loss of resale opportunity.

9. Governing law

These terms are governed by the laws of the State of Georgia, USA. The courts of Forsyth County, Georgia have exclusive jurisdiction.

10. Changes

We may update these terms. The version published on this site at the time of your order applies to that order.
